Terms and Conditions of Entry for the 3rd Audience Award of the Deutsche Telekom Interactive TV Award
1. The Competition's Approach and Objectives
The 3rd Audience Award takes place in the framework of the ongoing Deutsche Telekom Interactive TV Award. It is aimed at all television enthusiasts who are looking forward to the next generation of television and would like to share in making it happen. In the course of the competition, Deutsche Telekom gives television audiences the opportunity to acquaint themselves with and rate the concepts from the finalists of the Developer Award. Audiences may view the developers' contributions on the website of the Deutsche Telekom Interactive TV Award, and rate them by means of a system of points. All those who submit their views in this way are eligible to take part in the subsequent draw. To this end, all personal details must be submitted correctly.
2. Competition Process
Winners of the Audience Award are selected by means of a draw among all participants. Participants may register and submit their appraisals only once.
2.1 Audience Appraisals
Participants are requested to appraise the projects of the Deutsche Telekom Interactive TV Award by allocating points (1 = I don't like it – 5 = I like it very much).
An appraisal tool has been set up on the Deutsche Telekom Interactive TV Award website (www.interactive-tv-award.com). After viewing the contributions from the three finalists of the Developer Award, participants are presented with a rating tool to attribute up to five points per concept. A single appraisal suffices to make participants eligible for the draw. Entrants must finalize their participation by filling out the entry form. Participation results automatically upon submission of the form and confirmation through a security e-mail.
2.2 Timetable
Submission deadline for the Audience Award is November 28, 2008. The draw will take place by December 15, 2008. Winners of the Audience Award will be announced on this date at the very latest.
2.3 Conditions of Entry
Eligibility: All natural persons aged 18 and older are eligible to enter. Employees of Deutsche Telekom AG and companies associated with Deutsche Telekom AG as defined in Section 15 of the German Companies Act (Aktiengesetz/AktG) are excluded from entry.
Refund of expenses: All expenses incurred in connection with an application or entry are to be borne by the participants themselves. There is no entitlement to a refund by Deutsche Telekom AG.
2.4 Prizes
Deutsche Telekom AG is giving away three T-Home Entertain Comfort packages for 24 months, free of charge, including: a media receiver, installation (where desired), access to some 70 TV broadcasters, program highlights from the TV archive, Internet flat rate with high-speed VDSL 50 (where available), plus a telephone flat rate for the entire German land-line network. After the first 24 months, the contract is automatically extended for an additional 12 months, unless canceled at least once month before expiration. Following the initial 24-month contract, the fee for Entertain Comfort/Standard is 49.95 euros per month and 53.95 euros per month for Entertain Comfort Universal. Winners without access to T-Home Entertain will receive a 40” Samsung LCD television.
Participants may only enter once.
2.5 Intellectual Property, Rights of Use
The entrants agree that the appraisals they submit and any other ideas and contributions, independently of their form of presentation, may be used, commercialized, reproduced and made publicly accessible by Deutsche Telekom without restriction. By contrast, entrants may only make commercial use of their rights with the prior consent of Deutsche Telekom AG.
2.6 Data Protection
Competition entrants’ data is stored for the duration of the competition. All participants consent to the use of this data for project purposes subject to due regard for data protection regulations. This includes public announcement of the entrant's name in case he or she is a winner of the competition.
2.7 Liability
All information that entrants receive from Deutsche Telekom AG in connection with the competition is strictly for competition use. No liability for the information being accurate or complete is accepted.
2.8 Amendments to these Terms and Conditions
The right to make reasonable amendments to these Terms and Conditions is reserved.
2.9 Severability Clause
Amendments and additions to these Terms and Conditions of Entry must be made in writing. No oral side agreements have been made. Should, contrary to expectations, one or more provisions of these Terms and Conditions of Entry prove to be invalid, the validity of the remainder shall not be affected. In this case it shall be considered as agreed that the invalid provision will be replaced by one that comes closest to the sense and spirit and purpose of the original.
2.10 Legal Recourse
By submitting their appraisals entrants have no legal entitlement to a prize. Prizes are awarded by draw alone. There is no legal recourse.
2.11 Applicable Law / Jurisdiction
These Terms and Conditions of Entry shall be subject only to German law, with Bonn as the place of jurisdiction.
2.12 Binding Character
In submitting their appraisals the entrants agree to the Terms and Conditions of Entry
